Parts of this agreement
This agreement is between you (the “Customer”, “you”) and TouringTour Technologies Private Limited, a company incorporated under the Companies Act, 2013 with its registered office at D307, D Block, 3rd Floor, IITM Research Park, Kanagam Road, Kanagam, Tharamani, Chennai, Tamil Nadu 600113, India (“TouringTour”, “we”, “us”).
It consists of these Terms of Service together with:
- the Privacy Policy;
- the Acceptable Use Policy;
- the Refund & Cancellation Policy;
- the Cookie Policy; and
- your order form, subscription plan or written statement of work.
If an order form signed by both parties conflicts with these terms, the order form prevails for that customer only, and only to the extent of the conflict.
Acceptance of the agreement
You accept this agreement by creating an account, clicking to accept where that option is presented, or by using the service. If you are accepting on behalf of a company or other legal entity, you confirm that you have the authority to bind that entity, and “you” refers to that entity.
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. The service is a business tool and is not offered to consumers for personal use.
Description of service
TouringTour is a software-as-a-service platform for travel businesses. It provides modules for customer relationship management, itinerary building, booking, omnichannel communication, supplier and contract management, content publishing, website building and workflow automation, as described on our platform pages.
We provide the service on a subscription basis. We may add, change or discontinue individual features; where a change materially reduces core functionality of a paid plan, we will give at least 30 days' notice and you may terminate under clause 17.
Free trial and beta features
We may offer a free trial. At the end of the trial your data remains available for 30 days; if you do not subscribe within that period, we may delete it.
Features labelled beta, preview or early access are provided for evaluation. They are excluded from any service level commitment, may be changed or withdrawn at any time, and are provided as is without warranty. Do not rely on a beta feature for a live departure.
Sign-up obligations
You agree to:
- provide true, accurate and complete registration information and keep it current;
- keep your password and API credentials confidential;
- enable multi-factor authentication for administrator accounts;
- be responsible for all activity that occurs under your account; and
- notify us immediately at care@touringtour.com of any unauthorised use.
We are not liable for loss arising from your failure to keep credentials secure.
Organisation accounts and administrators
Where an account is created using your organisation's email domain, the organisation is the Customer and may appoint administrators. Administrators can add and remove users, change roles, access workspace content, export data and delete the account.
Users are responsible only for their own use; the organisation is responsible for the account as a whole, including all fees. If control of an account is disputed, we may suspend it until the parties resolve the dispute or a competent authority directs us.
Restrictions on use
You may not, and may not permit anyone else to:
- resell, sublicense or provide the service on a bureau basis, unless your order form permits it;
- reverse engineer, decompile or attempt to derive source code, except to the extent Indian law permits despite this restriction;
- circumvent usage limits, rate limits or access controls;
- use the service to send unsolicited commercial communication in breach of applicable law or the policies of WhatsApp, Meta, Google or any other connected channel;
- upload malicious code or attempt to gain unauthorised access to our systems or another customer's workspace;
- use the service to store or transmit content that is unlawful under Indian law, including content prohibited by rule 3(1)(b) of the IT Rules, 2021; or
- use the service in a way that impairs its availability for others.
The Acceptable Use Policy sets these out in detail and forms part of this agreement.
Fees, taxes and payment
- Fees. Payable in advance for the subscription term stated on your order form, in Indian Rupees unless otherwise agreed.
- Taxes. Fees are exclusive of GST and any other applicable tax, cess or levy, which we will charge in addition at the prevailing rate. Where you are registered, you must give us a valid GSTIN. Where tax is required to be deducted at source, you must furnish the TDS certificate within the statutory timeline; without it the deducted amount remains payable.
- Renewal. Subscriptions renew automatically for the same term unless cancelled at least 30 days before the renewal date. Recurring card and e-mandate payments are collected in accordance with Reserve Bank of India requirements, including pre-debit notification.
- Late payment. Undisputed invoices unpaid 15 days after the due date may attract interest at 1.5% per month or the maximum permitted by law, whichever is lower, and we may suspend the account after written notice.
- Price changes.We may revise pricing with at least 60 days' notice before your renewal date.
Refunds and cancellations are governed by the Refund & Cancellation Policy.
Bookings, suppliers and travel liability
This clause is important. TouringTour is a software provider. We are not a travel agent, tour operator, DMC or principal, and we do not sell travel services.
- When you make a booking through an integration — a GDS, bed bank, airline, hotel, transport or ferry provider — the contract is between you (or your traveller) and that supplier, on that supplier's terms. We merely transmit the request.
- We do not control supplier inventory, pricing, availability, cancellation rules or performance, and we are not liable for a supplier's acts, omissions, insolvency or refusal to honour a booking.
- You are responsible for verifying that any price, availability or confirmation shown is correct before relying on it commercially. If a supplier system returns incorrect data, our liability is limited to correcting the integration.
- You are solely responsible for holding the licences, registrations, bonds and insurance your jurisdiction requires of a travel business, and for complying with consumer protection and package travel laws applicable to your customers.
Data ownership and your content
You own your data. All traveller records, itineraries, supplier contracts, media and other content you or your users upload remain yours. We claim no ownership over them.
You grant us a limited, non-exclusive, worldwide licence to host, copy, transmit, display and process that content solely to provide, secure and support the service, and to comply with law.
You are responsible for the legality of the content you upload and for having the rights and consents needed to process it — particularly traveller personal data. You can export your data at any time while your subscription is active, in a machine-readable format.
We may compile aggregated, de-identified statistics about platform use for benchmarking and product improvement. Such statistics never identify you, your travellers or your commercial terms.
Personal data and privacy
Our handling of personal data is governed by the Privacy Policy. Where we process traveller data on your behalf, you are the Data Fiduciary and we are a Data Processor under the DPDP Act, 2023. You are responsible for giving travellers the required notice and for having a lawful basis to process their data.
Customers requiring a Data Processing Addendum, including EU Standard Contractual Clauses, may request one at care@touringtour.com.
Intellectual property and trademarks
The service, its software, design, documentation and all intellectual property in them remain our exclusive property or that of our licensors. Nothing in this agreement transfers any such right to you beyond the limited right to use the service during your subscription.
“TouringTour” and our logo are our marks. You may not use them without prior written permission, except to state factually that you use the service.
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free licence to use them without obligation to you.
Service availability and support
We target 99.9% monthly uptime for the production platform, excluding scheduled maintenance notified at least 48 hours in advance, emergency security maintenance, and failures in third-party supplier systems or your own network.
Support is provided by email at care@touringtour.com and by telephone at +91-9739-752-752 during business hours, Monday to Friday, 09:30–18:30 IST, excluding public holidays in Tamil Nadu. Plans with an enterprise service level agreement may have different targets, set out in the order form.
Disclaimer of warranties
To the maximum extent permitted by law, the service is provided “as is” and “as available”. We disclaim all warranties not expressly stated in this agreement, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that data obtained from third-party supplier systems will be accurate or complete.
Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profit, revenue, goodwill, business opportunity or anticipated savings, even if advised of the possibility.
Our total aggregate liability arising out of or relating to this agreement, whether in contract, tort (including negligence) or otherwise, is limited to the fees actually paid by you to us in the twelve months immediately preceding the event giving rise to the claim.
Nothing in this agreement excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded under Indian law.
We are not liable for any loss arising from a supplier's conduct or from travel services themselves, as set out in clause 9.
Indemnification
You will indemnify and hold us harmless against claims, damages, losses and reasonable legal costs arising from: your content; your breach of this agreement or the Acceptable Use Policy; your violation of any law or of a third party's rights; your relationship with your own customers and travellers; and any dispute between you and a supplier.
We will indemnify you against a third-party claim that the service, as provided by us and used in accordance with this agreement, infringes that party's intellectual property rights in India, provided you notify us promptly, give us sole control of the defence, and cooperate. This does not apply where the claim arises from your content, from modifications not made by us, or from combination with anything we did not supply.
Suspension and termination
By you.You may terminate at the end of your subscription term by giving at least 30 days' written notice. Fees already paid are non-refundable except as stated in the Refund & Cancellation Policy.
By us. We may suspend or terminate if you materially breach this agreement and fail to cure within 15 days of written notice; if fees remain unpaid after the process in clause 8; if required by law or a competent authority; or immediately, without notice, where continued access poses a security risk or involves unlawful activity.
On termination. Access ends, and your data remains available for export for 30 days before deletion in accordance with the Privacy Policy. Clauses on data ownership, intellectual property, warranties, liability, indemnity, governing law and dispute resolution survive termination.

Governing law and dispute resolution
This agreement is governed by the laws of India, without regard to conflict-of-law principles.
The parties will first attempt to resolve any dispute amicably through the grievance process in clause 18. If it is not resolved within 30 days, the dispute shall be referred to arbitration by a sole arbitrator appointed by mutual consent, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Chennai, Tamil Nadu, India, and the proceedings shall be conducted in English. The award shall be final and binding.
Subject to the arbitration provision, the courts at Chennai, Tamil Nadu, India shall have exclusive jurisdiction. Either party may seek interim injunctive relief from those courts to protect its intellectual property or confidential information.
Modification of these terms
We may modify these terms. Material changes take effect 30 days after we post the revised version and notify account administrators by email; other changes take effect when posted. The “last updated” date at the top of this page always shows the current version.
If you do not accept a material change, you may terminate before it takes effect and we will refund the unused portion of any prepaid fees. Continuing to use the service after the effective date constitutes acceptance.
If any provision is held unenforceable, it will be modified to the minimum extent necessary and the remainder stays in force. Our failure to enforce a right is not a waiver of it.
